About the Peanut Butter Salmonella Outbreak

The U.S. Centers for Disease Control & Prevention (CDC) said in a statement March 7 that 425 people in 44 states were infected with the strain of salmonella also found in the peanut products and 71 people had been hospitalized. Two-thirds of the cases began after Dec. 1, 2006, it said.

The CDC and Food and Drug Administration (FDA) announced that the cases of Salmonella infection have been linked to the consumption of Peter Pan and Great Value brand peanut butter that was manufactured in ConAgra's Georgia peanut butter plant. Any Peter Pan or Great Value brand peanut butter beginning with product code 2111 produced since October 2004 has been recalled in response to the outbreak investigation.

Marler Clark will pursue individual claims on behalf of all individuals who were hospitalized as a result of their Salmonella infections. In addition, Marler Clark will pursue individual claims on behalf of the families of people who died as a result of their Salmonella infections.

Marler Clark filed a class action lawsuit against ConAgra on Tuesday, February 20, 2007. The class action lawsuit was filed on behalf of all individuals who became ill with symptoms of Salmonella infections, but were not hospitalized as a result of their infections, and who have strong evidence of consumption of Salmonella-contaminated peanut butter and a resulting Salmonella infection. The class action lawsuit follows on the heels of two lawsuits Marler Clark filed on Friday, February 16, 2007.

Since the outbreak, Marler Clark has been working closely with other attorneys throughout the country who, like us, represent large numbers of injured consumers. Based on what we have already learned, it is clear than the problems at the Sylvester, GA plant were more systemic than presently admitted by ConAgra. We have retained experts in all the relevant disciplines that will assist in uncovering all of the problems at the plant. We are prepared to move forward, along with our experts, at the inspections scheduled for Monday, April 9, 2007, and on April 19/20, 2007.
