Litigation Update: May 7, 2007

Inspections at ConAgra’s Sylvester, GA plant revealed numerous potential food safety issues including holes in the roof which allowed water to enter the plant. ConAgra has suggested that moisture entering the plant activated dormant Salmonella bacteria previously introduced on raw peanuts. We expect that the FDA final report on its investigation will yield further insights into the possible routes of contamination.

We continue to perform our initial round of testing on left-over peanut butter. If your peanut butter is selected for testing we will send you a packet in the mail so you can package and send your peanut butter container to the laboratory conducting the testing. Testing results will help us determine the likelihood of Salmonella recovery from left-over peanut butter and will be one of many factors considered in presenting claims to ConAgra.

We continue to discuss different approaches to claim resolution with ConAgra and those other attorneys around the country who represent Salmonella victims in this outbreak. We hope to develop specific settlement proposals in the next months.
